How are superintendents in these states handling this messed up experiment?
Since it is legal, do you treat it as you would alcohol use? When someone shows up appearing to be stoned or intoxicated do you send the individual home and terminate them if they have a second offense. Just trying to get handle on this. Any suggestions are welcomed. Thanks!!

I would say the same rules apply as they would with drink. The problem will be proving it, if the individual wants to fight it. But even then, how do you prove a person was drunk, after the fact, if they want to fight it, unless you make everyone blow before starting the workday? I guess it is just one of those issues that will work itself out in the long run

    Kim,

We removed pot from excluding new hires from work, they are still screened pre-employment and if they test positive for pot they will be given a warning that lets them know that if they are tested for cause in the future that pot could lead to disapline or termination. Since the economy has improved we are having a tough time finding entry level employees at the resort. So it was only hurting us to exclude it. All supervisors are trained to spot drug and alcohol abuse and we have a pretty good system for dealing with it in the work place. A suspected employee is going to have the option of being tested or terminated. They can avoid termination if they accept treatment with a positive test. The problem for the pot user is it will stay in their blood system more than24 hours and well after the effects are noticible. That is why they get the warning with a positive pre-employment test. They will only get tested again for cause, which means a accident or 2 supervisors agree the employee appears under the influence.

Even though it's legal in Oregon to my knowledge there is no where within 50 miles anyone could buy it legally. So far the county and city governments have restricted sales as the law allowed since the majority voted against it. My resort landscapers do find the packaging from legal sales in Washington in our parking lots.
