Root liability Cancel The title field is required!

   Just received word that one of our customers, public facility, stepped on a root in an obvious area and broke his ankle. Where, if any, does the liability fall here? When you pay do you not assume all responsibility and liability?

   I am not sure how it is in your area, but years ago in Oregon and Washington if it was a living tree, too bad. But a dead tree, it should have been removed or marked as a danger. But these days who knows. Take pictures and hope insurance takes the lead. Don't talk with anyone about it unless you are covered. Hope it works out.
