So 6 weeks ago, I had a worker fall while repairing our elk fence and hurt his back pretty bad. There is a possible surgery in the future. Gallagar Bassett sent David Caruso (CSI Miami reference) up to talk to me and the employee and the witness. Again 6 weeks after the accident. I was not a witness, just the supervisor and I was questioned for about 15 minutes like I was hiding something. But the strange part is this...... The employee that was hurt had to sign a form answering the following questions........
    Are you HIV positive?
Have you been to a fertility clinic?
Are you seeking mental counciling or any psychologist?
Do you have any drug / alcohol abuse issues?

Caruso would not leave until he signed this paper. I have read a little that workmans comp has a different set of laws, but there has to be some limit to what they can ask if it has not relevance to a fall.

In questioning the three of us, every question was leading and he would ask the same question different ways trying to trip us up. It was pathetic.

Anyone else have an experience like this? Are there any rights for the worker? I felt like red flags were everywhere.

    thanks

They are trying to make sure you aren't in on the take. Happens all the time.

Personally I welcome the Work Comp CSI. Work Comp fraud is a major issue that can have a huge financial consequence to any golf course.

If there was some settlement occuring it might make more sense. The worker missed 13 hours and has to do physical therapy sessions. Seamed a little over kill for someone not missing work and no pay out. To me it seems the real cases get the 5th degree and the scams laugh all the way to the bank. o well

As a person that had to do the workers comp deal due to my back I can tell you it sucks. My issue was not missing time but rather just getting my back fixed. I continued to work, albeit on a light duty schedule. Workers comp does not want to repair you under their dime.

My dad worked out in the eletrical union in las vegas, nv. Whenever someone got hurt, workers would make sure you were not dying. If you were not, they would all disapear. Why? Because everyone involved or near the hurt individual would be drug tested.
